These Terms govern your use of the Ready Set Sim sites: readysetsim.com, shop.readysetsim.com, and the Ready Set Sim used marketplace. Two different things happen on this site, and which one you are doing changes who you are buying from. When Ready Set Sim sells you new equipment, Ready Set Sim is the seller. When you buy used equipment from another person through the marketplace, that person is the seller and Ready Set Sim is the venue. Each section below says which applies.
Agreement between User and Ready Set Sim
Welcome to Ready Set Sim. The Ready Set Sim sites (readysetsim.com, shop.readysetsim.com, and the Ready Set Sim used marketplace, together the "Site") are comprised of various web pages operated by Ready Set Sim ("RSS"). The Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of the Site constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for your reference.
Ready Set Sim operates an e-commerce store, a used-equipment marketplace, and a social platform for sim racing equipment.
Where these Terms and a policy published on the Site conflict for a specific order (the Shipping Policy, Return Policy, or the store terms shown at checkout), the policy governs that order and these Terms govern everything else.
Electronic Communications
Visiting the Site or sending emails to RSS constitutes electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing. Messages about an order, an offer, a shipment, a payout or a claim are transactional, are part of the service, and are sent whether or not you have opted into marketing email.
Your Account
One Ready Set Sim account covers every part of the Site. If you use this Site, including the MySim community features, the store, and the marketplace, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that RSS is not responsible for third party access to your account that results from theft or misappropriation of your account. RSS and its associates reserve the right to refuse or cancel service, terminate accounts, remove content, or suspend access to community features in our sole discretion for any reason including, but not limited to, abusive behavior, harassment, spamming, hate speech, impersonation, or violating any community standards or policies.
You agree that the information you give us is accurate and that you will keep it current. The name shown on your account is displayed to people you transact with, so that a buyer sees a seller's name and a seller sees a buyer's, because a marketplace in which the other party is anonymous cannot be one where disputes are resolved fairly.
Age and Eligibility
RSS does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may browse the Site only with the permission of a parent or guardian.
You must be at least 18 years old to buy or sell on the used marketplace. Buying and selling used equipment are currently available only to people located in the United States, with a United States shipping address and, for sellers, a United States bank account. Browsing the Site is available worldwide. Where a transaction is not available in your region, you may join the waitlist instead.
Links to Third Party Sites / Third Party Services
The Site may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of RSS and RSS is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. RSS is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by RSS of the site or any association with its operators.
Certain services made available via the Site are delivered by third party sites and organizations, including our payments processor, our shipping-label provider, and the platform that hosts our store checkout. By using any product, service or functionality originating from the Site, you hereby acknowledge and consent that RSS may share such information and data with any third party with whom RSS has a contractual relationship to provide the requested product, service or functionality on behalf of RSS users and customers.
User-Generated Content / MySim Profiles
Ready Set Sim offers a social platform called MySim, allowing users to create public profiles, upload images of their sim racing setups, write descriptions, comment on other profiles, and link to external social media or sim racing content. By posting or uploading any content to the Site, including but not limited to photos, comments, usernames, setup descriptions, and social handles, you grant RSS a non-exclusive, royalty-free, worldwide license to use, display, distribute, promote, and otherwise share such content on the Site, RSS-owned platforms, RSS social channels, and in marketing or promotional materials, without compensation or notification.
The same license applies to marketplace listings you create, covering listing photos, video, titles and descriptions, so that a listing can be shown on the Site, in search results, and in messages to interested buyers. It survives the sale of the item, so that a completed listing can remain as a record of the transaction, but RSS will remove a listing's public visibility on request once the item is sold.
Users are solely responsible for the content they submit and agree that such content will not infringe on any intellectual property rights, violate any laws, or contain inappropriate, harassing, defamatory, obscene, or misleading material. RSS reserves the right to remove any user content, disable comments, or terminate accounts at its sole discretion and without notice for violations of these Terms or for behavior deemed harmful to the community or brand.
User Content Rules
All users contributing content to Ready Set Sim, including through MySim profiles, marketplace listings, public questions and answers, private messages, comments, uploaded images, links, usernames, and descriptions, agree to follow a standard of respectful and responsible conduct. By using these features, you agree not to post or share any content that:
- Contains hate speech, threats, harassment, or abusive behavior
- Includes sexually explicit, obscene, or graphic content
- Promotes or depicts illegal activity
- Contains spam, advertisements, or solicitations unrelated to sim racing
- Violates any third-party copyright, trademark, or intellectual property rights
- Impersonates another person, user, or entity
- Is not your own photography or video of the actual item, where the content is submitted as evidence that you have the item
- Attempts to move a marketplace transaction off the Site, or to exchange contact or payment details for that purpose
Ready Set Sim reserves the right to remove any content and suspend or terminate accounts at its sole discretion for violating these content rules or any part of these Terms.
Affiliate Content & Disclosure
Some user profiles, especially within MySim, may include affiliate links to third-party vendors. RSS may earn commissions on purchases made through such links. This has no impact on product placement or visibility. Users understand that affiliate links do not imply endorsement or liability by RSS and that they assume full responsibility for any third-party transactions initiated via these links.
RSS also operates a creator code program. A creator code may reduce what a buyer pays and may attribute a sale to the creator whose code was used. Discounts applied through a creator code are funded by RSS, not by the seller of a used item: a seller's payout is calculated on the price they set, regardless of any code the buyer used.
Buying New Equipment from the Ready Set Sim Store
This section applies when Ready Set Sim is the seller. For used equipment bought from another person, see the marketplace sections below.
Ready Set Sim is an authorized dealer for the brands it carries. Orders placed in the store are fulfilled directly from the manufacturer's or distributor's warehouse, which is what allows RSS to offer factory-sealed stock with full manufacturer warranty coverage. Dispatch and delivery estimates shown at checkout are estimates provided by the brand, not commitments by RSS.
Prices, availability and specifications are subject to change without notice, and RSS may correct errors in pricing or product information and cancel an affected order before it ships, refunding you in full. Returns, cancellations, damaged deliveries and warranty claims for new equipment are governed by the Shipping Policy and Return Policy published on this site and by the store terms shown at checkout.
Compatibility information, configurator output, build recommendations and fit checks anywhere on the Site are informational. They are produced from data supplied by manufacturers and retailers and from what you tell us about your setup, and they can be incomplete or out of date. Verify compatibility before you buy; RSS is not responsible for a purchase that does not fit or perform as you expected.
The Used Marketplace: What Ready Set Sim Is and Is Not
On the used marketplace, the seller is a private individual. Ready Set Sim is not the seller, does not own the item, and never takes possession of it.
RSS provides the venue: the listing pages, the review process, the messaging, the payment, the shipping labels and the claims process. The contract of sale for a used item is between the buyer and the seller. Every used item is sold as-is, in the condition the seller declares, by that seller.
RSS is the merchant of record for the payment. That means the charge appears from Ready Set Sim, RSS calculates and remits sales tax where it is required to, and RSS holds the funds in its own account until they are released to the seller. It does not mean RSS sold you the item, and it does not create a custodial or trust arrangement over the money. Funds are RSS's to hold and pay out under these Terms, not property held on your behalf.
A listing marked "Verified" means RSS staff reviewed the seller's submission: photographs of the item with a single use RSS code handwritten in frame, the required angles for that category, the serial number, and, where the seller supplied one, a walkaround video. It means we checked the evidence a seller gave us that they have the item they say they have. It does not mean RSS examined the item, tested it, assessed its condition, or formed any view about whether it works. RSS never handles the item.
Condition is declared by the seller from a fixed five point scale. It is the seller's statement, not an assessment by RSS. The grades mean:
- Brand new: unused, with its original packaging
- Like new: mint condition preowned, or new without the packaging
- Used - Excellent: lightly used, with no noticeable flaws
- Used - Good: minor flaws or signs of wear, noted in the description or photos
- Used - Fair: obvious flaws or signs of wear, noted in the description or photos
The scale describes cosmetic condition and completeness only. It says nothing about function, because a seller may not list an item that does not work: whatever grade is declared, the item must be completely functional and fully usable. RSS does not test any item and does not verify a declared grade.
Buying on the Used Marketplace
Used items are bought one listing at a time, in their own checkout, from a single seller. They do not go through the store cart.
An offer you place is a commitment to buy at that price if the seller accepts it within the offer window, currently 48 hours. If the seller accepts, you will be asked to pay; if you do not, RSS may restrict your ability to make further offers. A seller may accept, decline, counter, or let an offer expire.
When you pay, RSS charges you the item price, shipping, the buyer protection fee, and any tax RSS is required to collect. Your payment is held by RSS and is not released to the seller until the carrier confirms delivery and the window to report a problem has closed. This is a payment-timing arrangement operated by RSS, not a third-party holding service.
After you pay, the seller has 24 hours to confirm that the item is still in their possession. The seller's shipping deadline runs from that confirmation, not from your payment. If the seller does not confirm within 24 hours, or tells RSS they no longer have the item, RSS cancels the order and refunds you in full without any action on your part.
After delivery is confirmed you have 3 days to report a problem. What that covers, and what it does not, is set out in the Payment Protection section below. If you do nothing, the funds are released to the seller and the sale is final.
Because the seller is a private individual, no manufacturer warranty, dealer warranty or right of return applies to a used purchase unless the seller separately agrees to one in writing. Consumer protections that apply to purchases from a business may not apply to a purchase from a private individual.
Initiating a chargeback with your bank instead of reporting a problem here does not remove your obligations under these Terms. RSS will respond to a chargeback with the record of the transaction, including the listing as submitted, the tracking, the delivery confirmation and the messages between you and the seller.
Selling on the Used Marketplace
To sell, you must be at least 18, located in the United States, and complete onboarding with our payments processor, which collects and verifies your legal name, date of birth, address, tax identification details and bank account. RSS does not see or store those details. For listings above $750, identity verification is mandatory before the listing can go live. RSS may require it below that threshold as well. Any seller may complete identity verification voluntarily at any price; where a seller has done so, RSS displays that fact on their public seller profile. Verification confirms the identity of the seller. It is not a statement about the item.
By listing an item you represent that you own it outright and have it in your possession, that it is not stolen, counterfeit, subject to a lien or recall, or otherwise prohibited under these Terms, that the photographs and video are your own and are of the actual item, that the serial number you give is the item's own, that the item is completely functional and fully usable, and that your description and declared condition are accurate and complete, including every fault you know of.
Every listing is reviewed by a person before it goes live, and RSS may request changes, reject a listing, or remove a live listing at its discretion. Approval is a review of your submission; it is not RSS agreeing that your description is accurate and it does not transfer any of your responsibility for the item to RSS. Listings expire after 60 days, and a relisted item goes back through review with a fresh code.
When your item sells you have 24 hours to confirm that it is still in your possession. Your shipping deadline runs from that confirmation. If you do not confirm within 24 hours, RSS cancels the order and refunds the buyer, and the cancellation is recorded against your account. If you no longer have the item you must say so; a listing for an item you have already sold elsewhere must be taken down.
Once you have confirmed, you have 3 business days to ship it, using the label RSS provides or your own trackable label where permitted. If you miss that deadline, RSS may cancel the order and refund the buyer. Repeatedly missing deadlines, cancelling sales you agreed to, or shipping something other than what you listed may result in your seller account being paused or closed.
Your payout is the price you set, minus the seller fee, plus the shipping charged to the buyer, minus what the shipping label actually cost. It is transferred to your connected account after the buyer's window to report a problem closes. If a claim is opened, the payout is held until the claim is resolved.
If a payout has already been made and RSS afterwards refunds the buyer because the item was materially not as you described, was never shipped, or was not yours to sell, you agree to repay RSS that amount. RSS may recover it from your future payouts or by charging the payment method on file.
Prohibited Items and Listings
The marketplace is for sim racing and sim driving equipment. You may not list:
- Anything you do not have in your possession, including pre-orders, drop-shipped items, group buys, and items you intend to acquire after the sale
- Anything that is not completely functional and fully usable. That covers broken, faulty, or intermittent equipment, items missing a part they need in order to work, and anything offered for parts, for repair, or as untested. It applies at every condition grade: “Used - Fair” describes wear, not a fault
- Counterfeit, cloned, or trademark-infringing equipment, and items with removed, altered or obscured serial numbers
- Stolen goods, or goods subject to a lien, finance agreement, or open insurance claim
- Items subject to an active manufacturer safety recall
- Software, licences, accounts, subscriptions, in-game currency or content keys
- Digital goods of any kind, services, labour, or shipping-only listings
- Loose lithium batteries, damaged or swollen batteries, and any item that cannot lawfully be shipped by the carriers we use
- Anything unrelated to sim racing, and anything unlawful to sell or to own where either party is located
RSS may remove any listing that breaches this section without notice, cancel any order arising from it, refund the buyer, and close the seller's account.
Marketplace Fees
Sellers pay a 6.5% fee on the item price. Buyers pay a 2.5% buyer protection fee, calculated on the item price and shown as its own line before payment. Both are shown to you in full before you commit. A seller sees the net payout while setting a price, and a buyer sees every line of the total before the card form.
Where RSS buys the shipping label, the buyer is charged the quoted shipping price and the difference between that quote and what the label actually cost is settled against the seller's payout. Where a seller uses their own label, the seller bears its cost.
The buyer protection fee is refunded when an order is refunded in full. It is not returned on a partial refund. RSS may waive or reduce either fee at its discretion, including through promotions and creator codes; a waiver on one sale is not a change to these Terms.
RSS may change its fees. A change applies to listings created and orders placed after it takes effect, never retroactively to a listing already live or an order already placed.
Payment Protection and Claims
Payment Protection is a claims process operated by RSS, funded by the buyer protection fee. It is not insurance and it is not a warranty on the item.
Your payment is held until the carrier confirms delivery. From that confirmation you have 3 days to open a claim. A claim can be opened where the item never arrived, arrived damaged in transit, is materially different from the listing, is not the item that was listed, or is missing parts the listing said were included. RSS will ask for photographs and will read the listing as submitted and the messages between the parties.
Payment Protection does not cover how a used item performs beyond what the listing describes, faults the listing disclosed, ordinary wear consistent with the declared condition, buyer's remorse, a change of mind, a fitment or compatibility problem you did not check before buying, or damage occurring after delivery.
RSS decides claims on the evidence available to it and its decision is final as between the parties and RSS. RSS may refund the buyer in whole or in part, require a return before refunding, release the payment to the seller, or split the outcome. Nothing in this section prevents you and the other party from resolving the matter between yourselves, and nothing in it makes RSS a party to the sale.
Marketplace Shipping and Delivery
Marketplace shipping is domestic within the United States. Shipping is quoted from a real carrier rate at checkout for the item's declared weight and dimensions and the buyer's address. A seller who declares those inaccurately is responsible for the shortfall.
The delivery clock and the claim window both run from carrier tracking, which is why every shipment must be trackable, including where a seller uses their own label. Local pickup and hand delivery are not supported: without carrier confirmation there is nothing to start the clock or close it, and Payment Protection could not be operated honestly on such a sale.
Risk of loss passes on delivery to the buyer's address. Where an item is lost or damaged in transit, RSS will pursue the carrier claim where RSS bought the label, and will refund the buyer under the claims process regardless of the carrier's outcome.
Payouts, Tax, and Reporting
Payouts are made to the connected account you onboard with our payments processor. RSS does not hold your bank details. A payout may be delayed or withheld where a claim is open, where the payments processor has restricted your account, or where RSS reasonably suspects fraud or a breach of these Terms.
Because RSS is the merchant of record, RSS calculates and remits sales tax on marketplace orders where it is required to. Sellers are responsible for their own income and self-employment taxes on what they earn. Where required, RSS or its payments processor will issue you the applicable tax form for your marketplace earnings, and you agree to provide the tax details needed to do so.
No Unlawful or Prohibited Use / Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to RSS that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.
All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of RSS or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. RSS content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use and will make no other use of the content without the express written permission of RSS and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of RSS or our licensors except as expressly authorized by these Terms.
International Users
The Service is controlled, operated and administered by RSS from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the RSS Content accessed through the Site in any country or in any manner prohibited by any applicable laws, restrictions or regulations. Browsing is available worldwide; buying and selling used equipment are available only as set out in the Age and Eligibility section.
Indemnification
You agree to indemnify, defend and hold harmless RSS, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, any item you list or sell, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. RSS reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with RSS in asserting any available defenses.
Because the contract of sale on the used marketplace is between buyer and seller, any dispute between them is theirs. You release RSS from claims, demands and damages arising out of a dispute with another user, save for RSS's own obligations under the claims process described above.
Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/OR REPRESENTATIVE PROCEEDING. Further, unless both you and RSS agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
Liability Disclaimer
The information, software, products, and services included in or available through the Site may include inaccuracies or typographical errors. Changes are periodically added to the information herein. Ready Set Sim and/or its suppliers may make improvements and/or changes in the Site at any time.
RSS provides recommendations for sim racing products based on user input and preferences. Except for new equipment sold by RSS in its store, RSS does not manufacture, sell, or control these products or services, which may be available from third-party websites or vendors or from private sellers on the marketplace. Users acknowledge and agree that:
- RSS is not liable for any issues, damages, or losses resulting from products or services purchased from third-party websites, including but not limited to defective products, shipping issues, product incompatibility, or dissatisfaction with purchases.
- For used items bought on the marketplace, RSS is not the seller. RSS makes no representation or warranty about the condition, authenticity, safety, legality, or performance of any used item, and no representation that a seller's description is accurate. RSS's responsibility is limited to operating the venue and the claims process described in these Terms.
- All recommendations, compatibility results and configurator output provided by RSS are for informational purposes only. RSS makes no representations or warranties, express or implied, regarding the suitability, compatibility, or performance of recommended products. Users assume full responsibility for evaluating their needs and making purchasing decisions.
- Some product links may be affiliate links, from which RSS may receive a commission. This does not influence the content or recommendations provided. Users understand and accept that any reliance on such recommendations is at their own risk.
Ready Set Sim takes no responsibility for any products purchased on a third-party website. Any products recommended by Ready Set Sim are recommendations based on limited knowledge provided, and therefore RSS assumes no responsibility for products that are incompatible. Users should verify compatibility, suitability, and any other unique requirements themselves.
To the maximum extent permitted by applicable law, in no event shall Ready Set Sim and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Site, with the delay or inability to use the Site or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the Site, or otherwise arising out of the use of the Site, whether based on contract, tort, negligence, strict liability or otherwise, even if Ready Set Sim or any of its suppliers has been advised of the possibility of damages.
Termination / Access Restriction
RSS reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. Users who violate these terms or any community standards may have their accounts permanently suspended or removed. This includes, but is not limited to, uploading offensive content, impersonating others, spamming, harassing users, listing prohibited items, misrepresenting an item for sale, or misusing the platform for non-sim racing purposes. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Minnesota and you hereby consent to the exclusive jurisdiction and venue of courts in Minnesota in all disputes arising out of or relating to the use of the Site.
Closing or losing access to your account does not end an obligation already incurred: an order in flight still has to be shipped, a payout owed is still paid, a claim already opened is still decided, and an amount repayable to RSS is still repayable.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and RSS as a result of this agreement or use of the Site. RSS's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of RSS's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by RSS with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law, including but not limited to the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and RSS with respect to the Site and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement.
Changes to Terms
RSS reserves the right, in its sole discretion, to change the Terms under which the Site is offered. The most current version of the Terms will supersede all previous versions. RSS encourages you to periodically review the Terms to stay informed of our updates.
Each version of these Terms carries a version date, and RSS records which version you agreed to and when. Where a change is material, you will be asked to agree again before you next list an item or complete a purchase. A listing already live and an order already placed remain governed by the version in force when you made them.
